What happened?

A Victorian construction company has been fined after a worker suffered fatal injuries in a fall from height at a residential construction site.

The case centred on a worker who fell through an unprotected stairwell opening while carrying out work at a building site. The worker sustained critical injuries and later died.

Following an investigation, WorkSafe Victoria prosecuted the builder for failing to provide and maintain a safe workplace.


Court outcome

The company pleaded guilty in court and was fined for breaching its duties under Victoria’s Occupational Health and Safety Act.

The prosecution found that reasonably practicable measures were available to prevent the fall, including proper edge protection and guarding around the stairwell opening.

WorkSafe argued that the risks associated with falls from height are well known across the construction industry and that suitable controls should have been implemented before work commenced.


Why this matters

Falls from height remain one of the leading causes of death and serious injury in the construction industry.

Despite years of awareness campaigns, inspections and prosecutions, workers continue to be exposed to unprotected edges, roof work and floor openings that can result in catastrophic outcomes.

In many cases, the controls required to prevent a fatality are relatively straightforward and inexpensive compared to the consequences of an incident.


Key safety lessons

Builders and site supervisors should ensure:

  • Stairwells, voids and floor openings are protected at all times
  • Guardrails and edge protection are installed before work begins
  • Workers are trained to recognise fall hazards
  • Site inspections are conducted regularly
  • Fall prevention measures remain in place as work progresses

Removing protection temporarily or delaying installation can create a deadly risk.

WorkSafe continues to emphasise that falls from height are among the most preventable workplace incidents.

Employers have a duty to identify fall hazards, implement appropriate controls and ensure workers are not exposed to unnecessary risks.

When those obligations are ignored, the consequences can be devastating for workers, families and businesses alike.
